1. Introduction

By purchasing, downloading, or using LaunchDayOne, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, do not use the Product.

These Terms are an agreement between you ("the User", "Licensee") and JD Solanki ("the Licensor", "we", "us").

2. Grant of License

Upon purchase, you are granted a non-exclusive, non-transferable, non-sublicensable, revocable license to use the source code and assets provided in the Product.

You are permitted to:

  • Use the Product to build unlimited personal or commercial projects (websites, web applications, software).
  • Modify the source code to fit your specific needs.
  • Use the Product for client work, provided the client does not receive the standalone source code of the Product itself for redistribution.

You are NOT permitted to:

  • Redistribute, resell, or share the source code, binaries, or any derivative works of the Product publicly (e.g., GitHub public repositories, npm packages).
  • Use the Product to create a competing product (e.g., a similar boilerplate or UI kit) where the primary value is the source code itself.
  • Share your license key or access credentials with third parties.

3. Intellectual Property & Ownership

The Product, including but not limited to its original source code, design, and documentation, remains the exclusive property of JD Solanki.

By using the Product, you do not acquire any ownership rights to the underlying code or intellectual property of the Product itself, except for the limited license granted above. However, you retain full ownership of the applications, projects, and end-products you build using the Product.

4. Refunds

Due to the digital nature of the product (source code and digital assets), all sales are final. Once you have purchased the product, we cannot offer a refund. If you want to try, You can check existing site as a live demo before purchasing.

5. Disclaimer of Warranties

The Product is provided "AS IS" and "AS AVAILABLE" without warranty of any kind, express or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

  • The Product will meet your specific requirements.
  • The Product will be uninterrupted, secure, or error-free.
  • Any errors or bugs in the Product will be corrected.

6. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall JD Solanki be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of (or inability to access or use) the Product.
  • Any conduct or content of any third party using the Product.
  • Any bugs, errors, or inaccuracies in the code.

Notwithstanding any damages that you might incur, the entire liability of the Licensor under any provision of this Agreement and your exclusive remedy for all of the foregoing shall be limited to the amount actually paid by you for the Product.

7. Termination

We may terminate or suspend your license immediately, without prior notice or liability, if you breach these Terms and Conditions.

Upon termination:

  • Your right to use the Product will cease immediately.
  • You must destroy all copies of the Product's source code in your possession.
  • Sections regarding Intellectual Property, Indemnification, and Limitation of Liability shall survive termination.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

9. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Product after those revisions become effective, you agree to be bound by the revised terms.
